Section 23 of the Water (Prevention and Control of Pollution) Act, 1974 as amended and Section 24 of the Air (Prevention and Control of Pollution) Act, 1981 as amended empowers any officers authorized by the State Pollution Control Board, the right to enter any location/industry etc. at reasonable times with assistance for the process of performing any of the functions of the State Board entrusted to him etc.
Inspections are usually carried out by the officers of the Board either individually or as a team. In order to standardize the inspection procedure, the Chhattisgarh Environment Conservation Board hereby issues the following instructions which shall be followed with immediate effect:
- Notice of inspection to the responsible person/occupier of the premises shall be served before the actual inspection of the premises. However, in case of urgency the inspection may be carried out without pre-intimation.
- The inspecting officer(s) shall visit the site/premises/ industry and surroundings to collect all the information as required in the prescribed inspection report in the presence of the responsible person/occupier of the premises.
- In case of new industry sites importance shall be given to the following details:
- Location and details of water bodies.
- Location and details of habitations.
- Location and details of other industries.
- Location and details of roadways and railways.
- Location and details of environmentally sensitive areas.
- In case of existing industries importance shall be given to the following details:
- All manufacturing processes/operations.
- Sources, treatment and consumption locations of fresh water and related records.
- The sources of generation of wastewater and air pollutants emission, their treatment/control arrangements and disposal/ usages of treated effluent and discharge (if any).
- The sources of generation of hazardous and non-hazardous solid wastes, their collection, handling, storage, transport, treatment and disposal activities and related records.
- Readings of flow meters fixed for measurement of consumption of water in different heads and wastewater pipelines.
- Readings of energy meters connected with wastewater treatment and disposal arrangements and air pollution control arrangements.
- Readings of online continuous stack emission monitoring system and online effluent quality monitoring system.
- Compliance of CTE/CTO/Consent Renewal conditions.
- The inspecting officer(s) shall collect samples of treated effluent/ emission, depending upon the requirement. In case of legal sample, the procedure available in the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 shall be followed.
- The inspecting officer(s) shall inform responsible person/occupier regarding non-compliance/violations (if any) orally and record them in the inspection register maintained by the industry.
- After completion of inspection, the inspecting officer(s) shall prepare an inspection report in the prescribed format and submit within 48 hours to the appropriate authority along with the non-compliance observed (if any) and recommendations for taking further action.
